General Conditions of Sale

1. Introduction

These General Conditions of Sale shall apply to all contractual relations between the clients of the site Cavicchi.it and the company Biliardi Cavicchi, based in Via Giovanni XXIII, 45 Guastalla (RE) - Italy, entered in the commercial register of Reggio Emilia with the reference 28153/96.

These General Conditions are the only ones which can be applied and they shall replace all other conditions, except preliminary explicit and written derogations. Biliardi Cavicchi can be obliged to modify some of these provisions; therefore, we advise our Clients to read the General Conditions every time they visit the site Cavicchi.it. The order confirmation shall be considered as an acceptance of the General Conditions, without any appeal being possible. By visiting our site clients engage to respect the General Conditions and the Conditions of Use herein.

2. How to make an order

There are 3 ways to make an order on-line :

The order confirmation will be sent to the Clients by e-mail, as a proof that the order has been registered.

It's necessary to place an order of minimum € 25,00 (the expedition charges are not included)

3. Information about products

The photos presenting the products are not part of the contract and Biliardi Cavicchi will incur no liability for them. The descriptions of the products are made by the suppliers of Biliardi Cavicchi, which declines all responsibility about their content.

4. Prices

The sale prices stated in our site are expressed in Euro (€) including the Value Added Tax, but not the delivery expenses.
The delivery expenses are always charged to the clients and are invoiced at the end of the order as an addition to the chosen products.
Biliardi Cavicchi declines all responsibility in case of mistake or use of a wrong conversion system as well as for the possible differences resulting from the comparison between the foreseen total of the invoice and the actual total of the invoice.
Biliardi Cavicchi engages to apply the prices stated in the Site at the moment of the order, but it reserves the right to modify the prices at any time.

5. Availability

The clients' orders are carried out as long as there are enough products available.
If the ordered product is not available, Biliardi Cavicchi engages to contact the Clients via e-mail within 30 days from the date of the order to inform them about the time which is necessary for the delivery of the product they have ordered.

6. Delivery conditions

The wares are delivered by Biliardi Cavicchi to domicile in more than 200 Countries of the World by express carrier. We shall ask for a refund of the actual transport costs, equal to the real cost we have paid and which will vary according to the ordered goods and to the country of destination.
The goods will be delivered as soon as possible and at the latest within 48/72 hours from the next working day after the dispatch of the order, provided that they are available in our warehouse.
We will deliver the goods at the address mentioned in the order.

If the orders are sent during the summer holidays, they will be despatched only when the Company will open.
Please be advised that the carriers carry out the transport and delivery of the products only on workdays (e.g.: for a product ordered on Saturday afternoon you'll have to count 48/72 hours from Monday morning, provided that the product is available).
Biliardi Cavicchi shall not be considered as responsible for the consequences due to eventual delivery delays or to the loss or damage of the order caused by the courier.
IMPORTANT: when the order is delivered by the express carrier ''SDA'', the Clients can check (provided that the carrier agrees) if the package doesn't show any damages or apparent anomalies. If the package shows evident damages, we recommend you to accept the delivery under reservation by writing in the Consignment Note "Goods accepted under reservation". Moreover, the clients must send an e-mail to info@cavicchi.it within 48 hours from the delivery to inform us of what happened. Please be advised that Biliardi Cavicchi declines all responsibility in case of external damages to the package, which are notified after the acceptance of the order. Please note that the right of withdrawal is of course still valid for possible functioning defects or external damages of the product.

If the products must be sent back by the Clients, these must organize the return of the products within 48 hours from their receipt, to the following address:

The products must be sent back in the original package, including manuals and every other accessory which was present in the package. The expenses for the sending back of the product are refunded by Biliardi Cavicchi to the Clients if the products were defective at the moment of the delivery. In all other cases the forwarding charges will be paid by the Client.
Biliardi Cavicchi informs its clients that a delay of 24 hours in the delivery can happen in case, for safety reasons, Biliardi Cavicchi needs an additional check of the client's bank details.
We can ask the client for complementary information to validate the purchase definitively.
To enable Biliardi Cavicchi to contact them if necessary, the Clients are requested to write:
- an existing e-mail address,
- a fixed phone number.
We are aware of the inconvenience this can cause our Clients, but these measures were taken to protect the commercial transactions from eventual frauds to the prejudice of the Clients themselves

8. Procedure for exercising the right of withdrawal

Information for the consumer according to the legislative decree 22/5/1999 No.185 regulating the consumer protection in the matter of distance contracts.
The supplier of the goods you requested is the society: Biliardi Cavicchi, Via Giovanni XXIII, 45 42016 Guastalla (RE) VAT number 00482860350.
The above Decree assigns you the right to withdraw from the purchase, within ten working days from the receipt of the goods, by sending us a registered letter with acknowledgement of receipt, at the following address: Biliardi Cavicchi, Via Giovanni XXIII, 45 42016 Guastalla (RE).
The withdrawal can be sent, within the same period of time, by telegram or fax (+39 0522/824637) as well, on condition that it is confirmed by a registered letter with acknowledgement of receipt within the next 48 hours.
If the buyer exercises his right of withdrawal, he shall return the received goods at his own expenses to the above mentioned company within ten days from the date of receipt of the goods. These must be integral and never used. The goods shall be sent carriage-free in a registered parcel. Neither cash on delivery nor freight collect parcels shall be accepted.
9. Method of reimbursement of the amount due

Biliardi Cavicchi shall refund it by bank transfer within thirty days from the receipt of the notification in which the consumer expresses his will to exercise the right of withdrawal.
The reimbursement can only be referred to the price of the product, while the transport and the delivery costs to domicile shall still be charged to the consumer.
The necessary condition to exercise the right of withdrawal is the substantial integrity of the product and of the package.

10. Protection of personal data

Information requested by Biliardi Cavicchi to the Clients is necessary to deal with personal data and confirm order as well as to issue invoices and warranty contracts. Without the aforesaid data, the order is automatically cancelled. If you want to register to this Site, you are obliged to provide us with your true and real personal information. The communication of false information is against what is stated in these General Conditions and in the Terms of Use of this Site.
Biliardi Cavicchi is authorised to collect, deal with and use personal data provided by the Clients. Data is computer-processed.
The Clients can easily have access to and modify their personal data, according to the laws which are now in force (Article 34 of the law of 6th January 1978). At any time Clients can send Biliardi Cavicchi a request to check exactly which and how much personal data has been stored (the access is strictly limited to your personal data). Your data can be easily modified upon your request.
Promotional e-mails containing offers, exclusive products and news will be sent to the Clients, provided that they gave their specific authorisation thereto, at the moment of their registration.
Biliardi Cavicchi is the sole company having access to the personal data of its Clients. Only Biliardi Cavicchi is authorised to send promotional e-mails to its Clients and exclusively within well-defined commercial operations.
